Greenshed,of course these devices need a legal basis. Their role in law is to corroborate an opinion. Yet the way the partnerships carry on , they keep mouthing off about "safety cameras", giving the public the false impression that this is somehow the law of the land. Like in the Colin Mo...

Hello fisherman. First of all I would like to say that I respect your opinions and your obvious experience of working in the courts. Secondly I did not start this thread with the intention of winding anyone up. I am not like our friend Greenshed. But there seems to be a presumption here that the aut...

It seems to me that speed cameras are now universally called "safety cameras". Everyone is jumping on the bandwagon with what is, in fact a description that has no legal basis. Fixed cameras are not mentioned in law. Mobile cameras or radar guns were authorised by the Traffic Acts of 1988 ...

Jomukuk, I am not advocating people break the law. What I have suggested is what I believe to be a legal loophole. Other legal loopholes have been touted on this site over other issues. At the end of the day anyone reading my posts does not have to do what I say. People can check matters out with a ...

Steve I disagree with your reasoning. Yes, speeding can lead to a summons, but the NIP has to be served first. And I insist that service means letterbox delivery or personal delivery on the doorstep. If an NIP has been served and you ignore it and any subsequent reminder, then a summons will be issu...

Wrong again Greenshed! How is the PC going to see you are in??? Does he have x-ray eyes that can see through walls? You are not obliged to open your front door unless the caller has a warrant, he would presumably shout out the fact and would have to show you it at the window. No one is obliged to op...

I was just waiting for Greenshed to get involved. I think, as usual, you are just "trolling", my friend. Your understanding of the law is somewhat flawed. I think most people on here have twigged that you work for a camera partnership, hence your vested interest. I think you should be worr...

If what you are saying is right and some operators are cascade trained, then this calls into question whether they have received proper certification. If not, all speeding allegations they make are invalid. There is also the question as to whether such people are properly trained in how to present t...

Hi there. I anticipated that some posters would say that mere posting of the letter by the police counts as service, and they only have to post it within the 14 day period. That's actually not true. There was a court case, I think it was in Hull a year or two ago. The police sent an NIP within the 1...

Hope this is in the right board section, but here is a fool-proof method to avoid the NIP if you are sure a camera has done you. The police have 14 days to get the NIP to you. So what you do is simply block up your letterbox for the 14 day period! Go to a DIY shop, get a suitable piece of wood, then...

Great news that Oxfordshire is going to turn off its cameras. Hope it now happens elsewhere. Wonder what Greenshed has to say about it eh? Oh dear, maybe he and his ilk might have to face up to losing their jobs!!

Thanks again. Your info is most appreciated. But I believe there is also something called a Full Disclosure Hearing, or pre trial review, which also should disclose whether they have enough evidence.

Thanks for the reply. That is very informative. I was under the impression the prosecutor always has to be an expert on motoring law, but that is clearly not the case. So if, for example, I went to court and defended myself, and the prosecutor says :"your recorded speed was such and such,"...

Can anyone answer the following:? When a speeding case goes to court, is the prosecuting solicitor always an expert on motoring law, speed camera issues and police procedures? Or is the speeding case simply given to any solicitor who happens to be on duty that day at that court? If this is the case ...

I can now report that the police have dropped the speeding allegation, but no photos were sent and no explanation offered as to how the speed was calculated. Incidentally, this camera is a dual speed/red light camera. If the camera is uncalibrated, would that not make red light allegations invalid t...

Not sure where on the Forum this post should be placed , so I will try here. I have read in some detail about Colin Montgomerie getting his speeding conviction overturned, and the whole issue makes me angry. The "civilian" operator, Christopher Griffin was shown to have been using the came...

Don't think Redspeed uses radar. However it is a requirement that Poloice scrutinize secondary check photos. If they haven't this is scandalous. How many other inocents are being done in this way, who cannot prove their vehicle cannot exceed a certain limit? Diabolical. Anyway, will keep you abreast...

Yuo're no doubt being sarcastic, so I will add some further details. The camera is on the A580 East Lancs Road,at Swinton, at the junction with Moorside Rd. Those who use this Road will know the camera concerned. The bus was a Volvo B9, the latest model, and cannot exceed 55 mph. We are investigatin...

I know someone who is a PCV driver and he has had a ticket saying he was doing 70 mph in a 50 zone. Trouble is, the bus is speed limited to 55!!!! It seems the camera concerned is a dual speed camera/red light camera called a Redspeed. Anyone got any suggestions how this so called accurate camera te...
