Is it still the case that yo can ALWAYS request the photograp when you get a nip through the door?

You can always request it...

...but you won't always get it!

In law they don't have to give you anything at all until such time as there is actually a court case against you and they wish to use the photo as evidence. When you are still at the fixed penalty stage they aren't actually obliged to send you any evidence at all, though they will usually give you the photos if you ask.

The reason is that if they don't it may well strengthen your case should you be unable to identify the driver from memory. If they have refused to give you a photo that might have helped you to do so then you may well be able to use this to your advantage.

From what I have read on Pepipoo it's best to say as little as possible so you don't give away what your plan is.
Eg. "Re: NIP Ref. ABC123. Please can I have a copy of the photographs to help identify the driver. Cheers, Bob."

The key words are "to help identify the driver".
