If trucks were forced off the road every time the wind got up enough to cause lane-wandering there would be chaos.

I'd actually argue that its preferable to wander into another lane than to tip over. Obviously neither option is really acceptable, but you see the point. I make a point of avoiding high-siders in strong winds, whether that be overtaking with a lane to spare (where possible) or just staying behind.

That said, since every other occupation that can be adversely affected by high winds sets upper wind-speed limits beyond which work stops, then that should also apply to lorries.

Sigh.. he still used the mobile and research shows that we are pre-occupied with the call up to two minutes later. (not peer reviewed and thus by no means conclusive.. )

I think that if no one had died .. 50/50 in insurance terms. But someone did die and the truck driver catalysed the events by striking the Clio. He had been on that phone before hand. His bad luck. It could be that the Clio driver also made a driver error.. but it seems to boil down to who the judge believed on the day in court.

The lorry driver will have grounds to appeal his conviction and sentence. But if his actions catalysed the sequence of events.. then justice must be served by his serving some penalty - and a ban and loss of livelihood for the duration is a hefty punishment in any case.

I am trying to bury my own bias.. as I abhor the use of mobile phones whilst driving in any case. Potential points on a driving licence. for using these awful things whilst driving a car.... it's one of the few things I agree with the authorities on.
