Manchester Evening - 6 January - page 2. Alan Salter reports.

Quote:

Motorist D Smith was locked in a police cell and ushered into court in handcuffs - over a speeding fine he had already paid

:furious:

The 21 year old from the Radcliffe area of Bury spend six hours in custody after popping down to the police station to sort out a mix up over a £200 fine.

:? £200 :? Blimey must have been copped pushing the envelope a bit.. or it might be including costs. :?

It gets better - sorry about the  icon

MEN wrote:

BICYCLE SALESMAN :rotfl:

Sorry :boxedin: It's just the irony :wink

now I've recovered- MEN article continues wrote:

Bicycle salesman Dayne had been caught speeding by a policeman using a speed gun and thought he had paid his debt to society with a fine and points on his licence

But the police sent him a letter informing him that there was a warrant out for his arrest over his non-appearance in court for the speeding offence. Dayne telephoned the police and then went to the police station.

Dayne told the MEN

"I spoke to the sergeant who said he should really arrest me there and then because there was a warrant out for my arrest. But because I seemed to be a nice boy - I should come back on Monday and sort it out with the warrant officer But when I went back on Monday morning - they did arest me   and took me to Bury Magistrates Court in a police car - where they put me in a cell.

"I was brought up to the dock in handcuffss surrounded by secuirty officers and I then explained thaat I had already been in court and had paid the fine. I showed them my dad's credit car statement with it on.

I hope you are paying him back Dayne. Kids  .. they think we are banker and that cash is a gift and not a loan if we are not careful to claw it back from them ... Kids

young lad in paper wrote:

I thought that would be the end of it.. but I could not believe it when they [i] adjourned for their lunch  They did say I did not have to return to my cell but that I was not allowed to leave the building. When they came back - they said there was a mistake, said sorry and I was now free to go!"

Nope .. not good enough :banghead: If this were my son.. I'd have been at the police station armed with our solicitor sorting it out - and if they persisted in arresting him. becaus ethe paperwork says they have to . then I think I would have had the daily tabloids in on this one.

Quote:

Dayne who had been beaten up whilst celebrating his 21st birthday two weeks before his court appearance added:

"I was still in pain from a broken jaw, concussion and cuts and bruises from when I was beaten up Apart from the fact they had made a mistake - I coulc not understand why I was handcuffed and locked in a cell for a speeding offence

Eeee by 'eck - Dayne lad . . you need to read the motoring sites... According to Dick .. you are public enemy number one ... and woe betide you if you ride a bicycle down an 'ill with double whites at a speed fast for you but not fast enough for the cops behind you .. - allegedly

Dayne is now suing the police for unlawful imprisonment.

His solicitor came out with the understatement of the year so far

solicitor in the MEN wrote:

Dayne has been very unlucky since he turned 21. we are pursuing his claim for injuries following the assault with the Criminal Injuries Compensation Authority but the scheme involves a lengthy waiting period.

The unlawful imprisonment us a straightforward case as the warrant was clearly issued by the court in error. [b] However no amount of compensation can make up for being held in a cell for a crime you have not committed - the crime in this case allegedly failing to attend court and pay ensuing costs.

A spokesman for Bury Magistrates' Court declined to comment

Another major embarrassment for the current system:

Letting off speeding cops in 2003 because the speed limit and cam logo had a black background instead of a white one.. and they were pinged over 40 mph in the 30 mph zone.. No one else pinged had their convictions overturned because of the incorrect sign (Cleveland ca 2003 - story was on ABD site at the time.. may have been archived by now)

Cop collecting takeway .. but uses a a convenient call on radio to plead innocence..

Numerous clerical errors

One scam in Humberside (2004) pinging everyone at 82 mph regardless of speed. Only discovered when people challenged on basis that they had set cruise control and investigation then proved the fault. In fairness - the prats in this case were reported as cancelling all tickets raised at the time and trying to contact those others affected. (Story appeared on some motorhead site in 2004

Incorrect positioning of scameras .. M4 Wales 2003 and Manchester 2005 tempo roadworks come to mind here..

Now they cannot even get the court paperwork correct.
