No .. I do not think so at all. "Driver" had stolen the vehicle. "Driver" was not licenced. "Driver" was not insured. "Driver" had "mens rea" when he STOLE this vehicle. "Driver" or rather - let's not be politically correct and refer to him as "chav critter who emerged from under a stone" deserves everything the court can throw at him

A STOLEN car which was being chased by police crashed into a van at a busy junction.
A man jumped out of the passenger side of the stolen Fiat Punto and tried to flee the scene, but was followed by a witness before being caught by police.
The yellow transit van flipped over and hit a Vauxhall Astra, which in turn hit a Nissan Almera, at the junction with Marsh Lane and Plodder Lane, Farnworth, shortly before midday today.
The 28-year-old driver of the Punto was arrested at the scene on suspicion of aggravated taking of a motor vehicle, dangerous driving and driving whilst disqualified.
His passenger, a 35-year-old man, was also arrested on suspicion of aggravated taking of a motor vehicle.
Both men were being questioned by police last night.

The driver of the van, aged 32, and the driver of the Astra, aged 34, were taken to the Royal Bolton Hospital with minor injuries.
Marsh Lane was closed for several hours while the debris was cleared.
One witness, who asked not to be named, said: "I was in a shop and came out when I heard the bang.
"A man got out of the passenger side of the car and tried to run away.
"I followed him up Bradford Road where the police caught up with us, but I didn't try to approach him, you never know what people will do to you these days."
Maxine Jackson, owner of Piscean, a kitchen and bathroom supply company on the corner of Marsh Lane and Plodder Lane, said: "I was in the back and I heard a huge bang and saw the van had toppled over.
"The van driver popped his head out the window and crawled out."
Last August a wheelchair-bound passenger was trapped in an overturned van and had to be rescued by firefighters after a crash at the same junction.
Unfortunately though.. you can guess what will happen as a "solution" from the final paragraph
By the way Jazz (sister) says Plodder Lane does have cam signs, watch your speed signs at the urban end near the Royal Bolton and Bradofrod Road where this incident occurred - and the odd scam van on the "ruralesque straight near the M61 end"
