Now this is one I don't understand....

I was issued a fixed penalty on the side of the road despite not admitting to the offence. The Single officer in the vehicle could provide me no evidence when I requested it stating that he had followed me for 0.3 miles travelling at 72 in a 50 and said that if I went to court it would be his word against mine and the last person to do this was fined £240. Now firstly is he able to issue the fixed penalty without me admitting to the offence? secondly can I request evidence of this? (which I know he doesn;t have?)

Was this on a motorway?

A single officer's opinion of speed? What does he have to corroborate this?

I'm not as knowledgable as a lot of people on here, but here's my 2pence worth......................
...... he can issue you with the fixed penalty notice as there is a reply section on the form. You have the choice of accepting the penalty or challenging it in court. Fill in the form accordingly and send with a covering letter asking for the statement of the officer, their training record, calibration & maintenance records of all equipment used to record/document the alleged offence.

If the police can provide all these things (by the sounds of it they probably wont be able to.....case closed) then you can start to work on your defence and disproving their evidence. If you PM me your e-mail, I can send you a PDF file that will explain how to do this

A single officer can issue a ticket for speeding even though you dont admit it,he probably evidenced it on a following check on a calibrated speedometer and that will be his evidence he corroborated the vehicle speed after he formed the opinion that you were exceeding the speed limit.
Was it a marked police vehicle if it was then you must have poor observations not to see him following you over the set distance he said he did.

Of course a police officer would never lie in order to gain a conviction

I do not think the policeman had the right to tell you of what allegedly happen in a court case as fine imposed would be up to the court/magistrate within their guide book as to what they can und cannot do as regards fine/points etc.

You have the right to plead innocence if you consider yourself innocent of 72 mph in a 50 mph zone :popcorn:


I would think the policeman would have to provide some evidence as to when the speedometer was last calibrated before clocking you at this speed.

You need to read all the documentation properly und seek advice from legal specialist if needs be.
