 Post subject: Totting Up Ban

Advise needed please.

I have the following 11 points currently on my licence

3 points April 06 SP 50

5 points Nov 06 SP 50 (was issued a fixed pentaly notice by policeman but he wrote down the wrong registration , pleased guilty by post and got 5 points !!)

3 Points Nov 07 SP 50

was stopped again 2 weeks ago doing 61 in a 40.

I am now waiting for court date and a possible totting up ban

I need my car for work , as I have to travel to 5 sites from Glasgow to Portsmouth for work.

Any advise of what to do / say in court ?

I was prosecuted by a Magistrates Court for an SP50, was given a 28 day ban and no points. Although, this was on a clean licence, and your previous convictions may well sway the judgement towards the revoking of your licence.

My first suggestion would be to get some legal advice.

First thing you need a solicitor ASAP to defend your licence in court as unless you are conversant (fully) with court procedure it is better to let / pay a legal brief to do it, remember you are pleading to not only keep your licence but your livelihood as well!

Try Citizens Advice Bureau as they used to have a scheme where they put you in touch with a solicitor for 1/2 hr of free advice (but am not sure about motoring cases) to see what they can do for you.

Secondly you are going to have to learn to OBEY speed limits or you will find yourself out of a job as well as losing you licence and by the way losing your licence for breaking the law is (and always has been) classed as "Gross Misconduct" by the now benefits agency so this means "no benefits for 6 months" and the courts now don,t regard loss of your job as "hardship" to allow you to escape a ban either so you need to act asap :!: :!:

Dont represent yourself at court, its quite funny but not very effective. A solicitor will appeal to the magistrates in the right way, but if they want to, they will ban you anyway. I know you've heard it alrready but people who need to drive to earn should really be doing it better than anyone

So how fast were you going on the motorways?

Get legal advice pronto. Try the pepipoo site as well. Cost you £100 to ask Nick Freeman a question on his website - but he does fight the law with the law :roll:

But why were you at 61 mph in a 40 mph zone? :scratchchin: when you are at a very dangerous level points-wise? Bit unwise of you regardless of whatever "pressing" reason at the time.

Be honest in the court. Try to prove you have learned something and are prepared to learn and be genuine in how you present yourself here. You won't escape a ban - but how well your brief argues and your demeanour in the court may well get a better outcome for you.

I'd make some investigations as to train travel combined with a decent road bike and get some lessons from an ADI as soon as your temp ban is up. :wink:

You really need to learn the importance of COAST. It does help discipline the "loud foott on the loud pedal" :wink:

*****update******

Have today been to court for my hearing.

DID NOT take a solicitor

Pleaded my case that I needed my car for my job

WAS NOT BANNED , I REPEAT WAS NOT BANNED !!!!!!!!

THERE IS JUSTICE AND IT DIDNT COST ME A PENNY !! (apart from the £350 fine)

Firstly maybe you could take the time to say"Thank You" to the people who took the time AND courtesy to offer help and advice in what could have been a difficult and possibly expensive time for you in court!

Instead you chose to "Gloat or Brag" about there being justice and for what!

Firstly you didn,t receive a ban, secondly you didn,t take a solicitor to defend you and your licence so presumably you didn,t ask for legal advice either so why did you come on here to ask for advice and then come back to gloat that there is "Justice after All" !

I very much doubt that you will learn by your mistakes as should you appear in court again on charges of speeding before any of your points run out I would think twice about asking for advice on here again with your blase attitude to the advice given.
