The NIP has to be served (sent out, not necessarily received) to the registered keeper of the offending vehicle within 14 days of the offence.
If your boyfriend was the registered keeper of the vehicle at the time of the offence, and his details are correct on the database, then his late NIP could well have timed out – check any date stamps you see on the outer envelope for evidence.
However, if the NIP was served to the wrong address (details for the registered keeper being incorrect or out of date) through fault of the registered keeper , or the NIP was sent within 14 days to the registered keeper which wasn’t your boyfriend at the time of the offence (friend’s/relative’s car, company car, hire/lease car, car had just been bought) then the courts have 6 months to chase up your boyfriend. You might have to contact the sender to determine if this was the case.
