Hello. I've been notified by my company to expect an NIP from Thames Valley following a letter from the car lease company to HR. HR have given me the date and time of the alleged offence and I was actually in my office at the time. I already have someone taking stills from the video footage from the office security system that show both my car driving into the car park and me moving around the office at times making it impossible for me to be where TVP say my car was. I suspect that either the number plate was mis-read or my plates have been cloned. What's the best way of handling this when the NIP turns up?

:welcome: alfie

(I am not a solicitor and therefore cannot advise you.)

I would initially ask for all the video and photographic evidence that they have, and request too that all of it is 'in full'. Some areas have the habit of providing 'cropped' (only showing part of the image) images, or not all of the frames of the video evidence.
I would take legal advice to know how best to proceed, however an approach with your evidence that you were not at that location might see the CPS drop the case. You do need to be careful with all approaches directly as you can provide more details than necessary or state something incorrectly and no one wishes to waste the Court's time.

If you cannot afford a Lawyer even for some advice and some will provide a limited amount on the phone for free sometimes, then you can apply for Legal Aid (certain cost amounts vary, some are given for free, some have to be paid back, depends on circumstances etc., etc.) or the CAB (varied help), or of course limit the legal help to the bare minimum of advice only, and act for yourself in Court. The Court Clerk should be able to help to a degree with all the legal processes, but cannot advise you with your specific case.

Hi Alfie,

You may find it helpful to go to our website http://www.notmycar.co.uk

If you would like to contact me on enquiries@notmycar.co.uk I will be happy to provide free advice and potentially some assistance if the matter becomes difficult to resolve.

We fully understand the predicament you are in.

Alan

Not sure why I would want to enlist the help of some greedy barrister at this stage but hey, whatever. Turns out that the rear view photo is of a 2.0TDi whereas I drive a 2.0T. Job's a good un.

Whilst some people will offer free assistance you obviously do not have to accept it ! :)
Some definite and clear variation to your vehicle, will obviously help, so that sounds encouraging.
