I was alleged to have been speeding in March 2005 59 in a 40 and was caught on candid camera LTI 20/20. After many letters to anf from the camera partnership and myself mainly to do with exact locus of the Police vehicle and other technical anomolies 5 months had passed when 2 officers appeared at my door and and had accused me of owning the offending vehicle (when infact it was a loan car as mine was being repaired at the time). I was then charged under sec 172 Aug 09 2005, i then received a date for a pleading diet. i was acting under pf instructions and low and behold in Jan 2006 a further 2 officers appeared at my door to escort me to a night on the tiles at her majestys pleasure. I then sought legal council and was told to plead guilty to sec 172 charge, but what about my right to silence afforded to a common criminal, rapist etc?
Can anybody give me some pointers????

Absolutely this is what they wanted to do, but i did get a sorry from the officers concerned. I have since complained to Lothian and Borders Police and was told the matter was "sub judice" and they couldnt talk about it until the outcome of my trial.

Kwacker, there's something missing here, some important detail as to why you were arrested and why you were detained.

You are entitled to a copy of the custody record (for up to a year after your arrest) get it and it should have the reasons for your arrest and just as importantly the grounds for your detention recorded on it.

(I'm guessing that either a) All previous attempts to serve a summons on you failed or less likely b) You were convicted in your absence and a 'No Bail' warrant was eventually issued)

Sorry i have been out the country for a few weeks but the Police had come to my door to arrest me but it was a mistake on the courts behalf so i actually didnt go to the cells, i am awaiting the outcome of the intermediate diet.

Ask for a copy of the evidence of the speeding allegation, if necessary under the data protection act, so you can check if it was your car that was recorded, or possibly a clone. They should be prepared to give you at least one photo even if you do not accept you were the driver.

If you accept you were the driver then the photos and videos are personal information held by the police about your movements. The police may claim exemption from providing this, but the ICO (information commissioners office) ruled for me that the police were not exempt from providing this information.

To late i was found guilty today and was fined £150.00 and 3 points. The Sherriff didnt want to ban me as i drive for a living, bless him !!!!!

God i hate this lot :evil:

Well not too bad, it could have been much worse.

Were there any expenses to pay ?

There are no court expenses in Scotland.

But what really angered me was i sat in on 6 trials before i was heard and if you are a junky caught stealing from a shop, you get off, if you are an alcoholic with a list of criminal convictions and assault 4 Police officers you get off, if you have a methedone habit and get caught stealing from a shop you get off, if you shout this is all F**king bulls**t your honour, you get told to be quiet you get off BUT if you commit a motoring offence alleged or not and you have a clean bill of health,no convictions you get DONE and it makes me bloody angry. :evil: :evil: :evil:
Where is the justice in that?? The law of the land seems to favour real criminals, god i can rant and i am sorry if i have offended but what sort of law does this country run???????????????????????????????????????
