'Shocking' road tragedy averted
A SERIOUS crash that could have killed road users was prevented after two men were seen putting electrical cable across a dual carriageway in Kent.

CCTV operators alerted police at 2.30am this morning after the men were spotted on Kimberley Way, Ashford.

Police believe they were going to film the outcome on their mobile phones.

The cable had been placed at a raised level and would have caused a motorcyclist to be thrown from their machine causing serious or fatal injuries.

Officers arrested a 23-year-old and a 22-year-old after a search of the area. They are being questioned at Ashford police station.

Ch Insp Stuart Kehily said: "It is shocking to think what could have happened if a motorist had driven into this cable.

"Thanks to the swift action of the CCTV operators and patrol officers, a tragedy has been averted."

It will be difficult to charge them with attempted murder unless they can demonsrate intent

shocking behaviour btw and not even young kids

How can they show there was NO intent?! They strung something accross the road in order to video someone crashing into it.

exactly the intent was to cause a crash..

intent to kill - Unlike murder, which requires an intention to kill or cause grievous bodily harm, attempted murder requires evidence of an intention to kill alone. This makes it a difficult allegation to sustain

A more likely charge will be Attempting to cause grievous bodily harm with intent. Contrary to sec 18 of the Offences against the person act 1861

It would of course be sensible to offer attempted murder and attempted GBH as an alternative charge This way the Jury gets to choose.

its all about the Defn of the law and case history I'm afraid

Exactly. Mrs W's ex-fiance was killed when someone kicked him in the head in a scuffle but the assailant wasn't charged with murder because they knew they could never prove the kick was meant to kill.

It's the kind of one where you want the book thrown at them. Although I don't condone their acts, I can to some extent understand muggers and thieves, because they get some benefit from the crime. People like this attempting to cause severe suffering or death due to boredom or a whim lack even the most basic empathy for others, and a complete lack of a sense of right or wrong, and are the kind of people I would like to see at least locked up for a long time.
