Hi everyone,
I had a quick question about the process of naming a driver on an NIP, I'm a motor trader and the car in question was a part ex that I took in, I lent this car to a friend who lives in Europe and was back visiting for a week and he went through SPECS cameras at an average of about 80 MPH instead of 50 MPH as living abroad he didn't know what they were.
No doubt the NIP-providing the cameras were working and pointing at his lane that is, will no doubt go to the previous owner of the car who will pass it on to me and I will be required to name the driver.
Does anyone know what I should do about naming a driver from another country?, he is in fact a UK citzen but as far as I'm aware doesn't have a UK Licence anymore, can I just provide his name and address abroad if I get an NIP, and will that be suficient for them?.

Having received a NIP, your obligation is to provide the name and address of the driver at the time of the alleged offence (assuming that you know who that is likely to be).

You have no further obligation - any suggestions that you do, made by the Police of camera partnership, is just another bluff.

At a later time the question of insurance may come up. If he drove on your trader insurance, then that's fine. If you lent him the vehicle on the express condition that he provide his own insurance that's fine too.

If it was you driving and you're thinking of blaming it on a ficticious person, we'd recommend strongly that you think again. You can get banged up for attempting to pervert the course of justice with that one.

Most speeding tickets are defendable because the prosecution have to jump through many hoops and they are sloppy.

Thank you for the heads up, another person was genuinly driving the car and if an NIP comes through I will provide his address, and I gather this is all I'm obliged to do from your previous post even though it will be a forigen address?. I didn't think to mention SPECS cameras as he was only borrowing the car for a couple of days, he mentioned about people driving slowly after the Dartford tolls, when there wern't any roadworks going on and I asked if he did too, and I just thought D'oh at his response.

Bad luck for your friend, but unless he's planning to move to the UK this wont affect him much, apart from the £60 bill.

He will have to apply for a "UK Counterpart" licence, basically it's like having a UK licence in addition to his foreign one, with the added bonus that it's completely worthless and doesn't permit you to drive anywhere. The points will be applied to this and if he does move to the UK then the points will stick. Otherwise he can just file it away and forget about it.

Not sure if he'll have to declare this to his insurer though.
