 Post subject: So, where would I stand?

I got stopped yesterday by a lone copper in an umarked car for using my mobile phone while driving. Luckily I got let off with a warning-for which I was grateful as it could have been far worse.

However, I wasn't using my phone. My car has factory fitted mirrored windows in the rear windows and boot which are impossible to see through from outside unless it's dark and something is coming the other way. It' simply not possible for the officer to have seen through them from 2 cars back in a line of traffic (that's when I clocked them)-and the only time the officer was close enough to possibly see me in my mirror, said officer was so far up the arris of my car that had I braked I would still have an unmarked impaled on my towbar.



One, where would I stand if I got rear ended by a police officer-and two, what woud have happened if I hadn't been let off with a warning?

What made him think you were? I keep my phone on the boot so he would have had one heck of a job trying to lecture me on that one!

If you ended up with any car hitting your rear end I guess it would be best to let the insurance companies sort it out. And maybe a quiet word with the local rag....

I don't know. I did the sensible thing-said nothing apart from being polite and as soon as I realised it was a warning only, said thanks and left quickly!

Well, it's provable if you were or if you weren't on the phone, the phone itself will note calls and times and so will the network, so it's a case of "um, no I wasn't, officer"

The princess of a WPC that pulled me over tried that one too -after making several claims about my standard of driving- which, although I found quite startling, were somewhat subjective matters, so i listened to what she had to say- then climbed way too high on her little pedastal by claiming I was talking on a mobile, which isn't subjective at all, thus I offered her an oppertunity to prove her "observation".

which she declined :roll:

1. Use of hand held call or text = easily provable in the absence of hands free device :popcorn:

2. If rear ended by any car .. including a cop car.. Unless one can prove an emergency stop for no reason.. a brake test .. or an un-signalled lane change // - then the buck for the rear ender fender bender rests with the idiot who failed to leave a decent gap to stop in. :roll:

3. We do not do stupid enforecement here We do what is fair and safety led to all :popcorn:

I neither confirmed nor denied anything. The officer in question did a check on my ID and came out with 'don't let me see you on your phone again or I'll...' at which point my thoughts were 'oh thank f**K for that-wrong idea but they aren't going to push it'

It does worry me a little that should I scratch my ear at the wrong time it could be said that I was holding a phone. Mine stays in the pocket when driving and I will not answer or use the dam thing in the car unless the engine is switched off and I guess that it is fairly easy to prove by the call log. Lets look at the time of my last received / made call should settle it but not a situation I would like to be in.

I think the problem was only caused by the security film on my windows. The most you can see through them from outside is a silhouette.
