Back in June of last year I was caught by a speed camera in mid wales. I admitted it was me and sent of my debit card details and my licence and waited. Seven months later I realise that I had not actually heard anything and had not recieved my licence back! I have since written to the safety camera partnership, and they have passed me on to the fixed penalty ofiice. Despite four letters, I have not been able to find out who holds my licence. DVLA have no record of my licence being sent to them and the bank have no record of any payment being taken. The letters I have had from the Scameraship simply say someone will get back to me or to write to the fixed penalty office. The last straw was today when I get a letter from the Scameraship saying that the letter to the fixed penalty office of the 11th of March has been returned to them as the office has been transfered to Denbigh and they would forward the letter on. WTF does it take them four weeks to have letter returned and why did they not give me the correct address in the first place! My only option is to tell DVLA that the licence is lost and pay the cost of a replacement.

What I would dearly love to do is sue the partnership in the small claims court for the cost of a new licence, but can you sue a Partnership? What is the legal entity?

What a nightmare for you ! sorry to hear this.

You say you sent of these details to the DVLA - was that recorded delivery ?
To be wise after the event - always send anything to DVLA with proof - even a certificate of posting - costs you nothing but proves posting - no guarantee delivery - which would be my only choice when sending anything to them - that way when it goes missing there is a trail to follow. When they locate the gap whoever that is - they are to blame and then a clear path can then be followed.

Do visit pepipoo forum for the legal side of this. They have legal professionals, that an help you there, or seek legal advice.
I am not a lawyer and cannot advise you. I would write to DVLA and request the return of your licence. It will never have gone to any camera partnership (I would be highly suspicious if any of them ever asked for it too!) So if you can be sure that you sent it to them, it is in one of three places - on route to or from DVLA (inc mis-delivery), at DVLA or stolen.

It sound like they are not pursuing the ticket either or they would have contacted you again ?- do you have all their original documentation ?
Since you seem sure that the credit card details are unused (so doesn't sound like a form of a hoax!), it will only be the cost of the new licence that you can 'sue them for' as I see it, but you need to give them a chance to provide you with a new or replacement licence first.
So ask DVLA having explained the case and see what happens. You will need to provide them with all your details and when you passed your test etc... I would call them and find out what they need then send it off to them (Guaranteed delivery of course) ... start a file and take a note of everything that happens inc who you talk with and when !

The licence and card details were sent direct to the partnership as they requested. Fortunately I kept a copy of the licence. They cannot prosecute for the original offence as it is time barred (6 months).
