I have rec'd a NIP and a conditional offer of fixed penalty dated 22/3/04 for for a speeding offence dated 22/02/04. I have read that they have to notify me with in 14 days of the offence. Although, my car is registered to my company, it is the one and only company car as it is my own company. Does this make a difference??

Also, I wrote a letter asking for information about the type of evidence they have as there are no fixed Camera's on this, quite short, stretch of road and I did not see any police cars or mobile vans. According to the back of their letter all fixed and mobile camera locations are clearly signed. I saw no such signs.

As yet I have rec'd no reply and the 28 days notice is up today and I have not yet returned either forms!!

Can anybody out there offer me some advice???

The first NIP in the chain has to be sent to you within 14 days, but there are exceptions. See http://pepipoo.com/NewForums2/viewtopic.php?p=266#266 and http://www.pepipoo.com/NIP.htm for more details on the whys and hows.

They have 14 days to send the NIP to the registered owner. For company cars that means the NIP might first go to a leasing company or a fleet management company, get bounced back to the police, then get sent to the company the naughty driver works for, before being bounced back a 2nd time, before finally being sent to the driver. I saw this happen where a NIP was received after almost 5 weeks, but because the police had sent it out to the fleet management company that the car was registered to within the 14 days they were okay and the guy had to pay up. There may be other ways for you to dodge this one, but the 14 day limit may not be it unless you can prove they took more than 14 days to send the NIP to whoever the car is registered to.

Thanks for your information, It never dawned on me at the time that the registered owner would be leasing company. I guess they probably just filed in the form with my company details and returned it to them so the leasing will probably not have a record of when they rec'd it. So I think s**t out on the 14 day law.

I am just :evil: that I did not see them, I have spoken to the ticket office and they claim that I was got by mobile "yellow" speed van and would have been clearly visable. There are no, fixed, speed camera warning signs and the ticket office claim there would have been tempory signs erected. The stretch of road I got caught on is an open strech of duel less than a mile long. I am certain I would have seen it if it was "clearly visable" It obviously wasn't doing it's job properly!! Not only that, by co-insidence my friend, who lives in a different part of the country, also got caught a week earlier on the same stretch of road going in the opposite direction and he never saw what got him either.

The whole situation makes my blood boil. It almost wants to make me set up some sort of survailance on this road to find out where they are operating and put up my own camera warning signs! I bet they are catching hundreds on this road.

For your information it is the A11 at Barton Mills where the road changes from 70~50 in one direction and 60~50 in the other direction. It is a relitively new change and use to be 70.

Basically, I think I have resigned myself to another 3 points! 6 in a year now.

Don't give in just yet. If you were caught by a mobile van, they were most likely using an LTi 20-20 laser gun. You may want to check out the PepiPoo forums. Look for threads where people are pleading not guilty, and demanding full disclosure of the video evidence. You can then decide whether or not you want to follow the same route.
