Happy new year to all.

I drove for the first time through the M42 Varable speed limit. Noticed at the end the NSL was Black With white stripe ? On way back payed more attention and mandatory limits are red circle with WHITE text on BLACK background is this a legal sign ?

PS - are the cameras run by the SCP ? If so how have they been justified by KSI's etc ?

Are they not the same as the gantry signs on the M25 VSL sections?

Hi All,
Thanks all for the information. I remember a couple of years ago an MP getting involved in speed cameras in roadworks. The people being caught when the cones had been removed at night were complaining. The problem was that once a reduced limit was applied for and granted it could not be rescinded - i.e. it was fixed for a period of time. They were looking to change this so that limits applied only when the workforce and cones were present - i.e. a little bit of sensible flexibility. I do not recall this happening.

So has the law changed ? How can someone decide the maximum LEGAL limit should be lowered ( on the fly ) to improve traffic flow ?

I wonder whether or not it is actually legal for speed limits to be set for reasons other than 'safety'.

i seem to recall something about secondary legislation and ministers actiing ultra vires or beyond the powers granted to them under the primary legislation - which i assume in this case would be the RTA or such like that brought in speed limits.


if the act sates that speed limits are to reduce accidents is a minister then allowed to use them to control traffic flow without additional primary legislation?

I think there was a case recently where the some speed limit signs were deemed by a court to be invalid because they weren't black numbers on a white background enclosed in a red circle. If that is the case then legislation to allow non-conforming limit signs, such as these, to be lawful would need to have been sanctioned.
Has this happened? Where in the Road Traffic Act(s) is this information to be found? Maybe one of the BiB over on Pistonheads could tell us.
