I was driving home on the motorway today in lane two and a hatchback car drove past doing about 80-85mph with the rear hatch door wide open. I caught up with him further on due to him pulling over to go off on a slip road. I couldn’t see anything sticking out that would not allow the hatch door to close, just what looked like a couple of sets of golf clubs in the back.

Question: Is it legal to drive on a motorway with the rear hatch door wide open?

I doubt whether there is a specific offence of driving with ones rear hatch open.

However, its probably covered in some way under the condition and use of the vehicle, i.e. driving with some part of it unsecure or whatever.

Nothing illegal unless the manufacturer was prepared to state categorically that carbon monoxide fumes would be drawn into the vehicle to a degree that the occupants could be affected, and that would depend upon whether the windows were up or down.

What about the rules regarding number plate visibility? If the plate is attached to the tailgate, and the tailgate is open far enough...
