Hi, newby here so be gentle! Got a NIP drop through the door on 18th November for alleged offence on 15th October, wrote back asking for photos to identify the driver etc. at the same time pointing out the lapse of the 14 day period. They sent back the photos, and also added that the NIP complied with section 1 of blardy blaa etc. I have sent this back today, pointing out the 14 day thing, and telling them i still cannot identify the driver. Should this go to court, where would I stand regarding the 14 day period?

Eddie, just out of interest, what was the date on the post mark of the letter you received?

If I where you I’d go over to PePiPoo and fill out there standard NIP wizard. There are people over there who can give you better advice.

Are you correctly registered as the registered keeper of the offending vehicle? If not then the 14 day rule won't apply.

Post mark on the envelope is is 20/11/06, as regards being registered keeper onll brought the car on the 7/10, but they have not mentioned this point. What about not being unable tidentify the driver? It could be 1 of 3 people, and I cannot tell who is driving so what do i do now? The y have told me they will forward all correspondence to CJD for consideration of instigating proceedings, is this likely. I really do not want to pay this fine, or take the three points.

How did you manage to get it through the door on the 18th if postmark was 2 days later?

nice one went to pepipoo, and it looks pretty good to me!! Got a template to use as well so we will see what happens. Its gotta be worth a punt i reckon.

Just a bit of an update on my situation here. Still heard nothing! Is it too early to be cracking open the pomagne do you think? I mean this was last October, surely I would have heard something!

I would say you are in the clear (unless it is Hull or humberside, not sure which). The speeding timed out mid april :thumbsup: and the 172 should have timed out as well mid may.

The S.172 hasn't timed out yet.

No offence is committed until 28 days after service of the NIP/S.172 request. Time out is 6 months from then.
