I have to say IG does know his stuff as it does confirm what he post on the thread where the texting driver hit the red light jumping cyclist.


If you recall .. IG passed comment that it was the act of actually reading message whilst driving which can constiture "using the handy". We contest that she may not have been using the device at point of impact.. und there are perhaps still some avenues open to her to appeal there... but these will be points of law for the courts really :popcorn:


But.. per the Vine prog . und Loophole Freeman claim he could argue the toss on this one too on the prog.. just after 1 pm news if you like to listen again to it. :wink:

He had phone in back pocket whilst driving. It dig into his bottom. He fish out und chuck on dash. Passing police car see this. They accuse of using phone. Only this phone switched off :popcorn: It become similar ot placing purse,. wallet .. keys.. block of choc on dash. Would this be viewed the same if same action but not a handy? :popcorn:


It boil down perhaps to same as law if you sleep off hangover in car in a camp site. There ist the intent. All it take to activate phone ist a push button after all :popcorn:

Acting sergeant from Surrey phone the prog.. to say it common sense judgement on part of officer.. which again back IG who state his team do apply this common sense dependent on what seen.


But I post for comment from all side of fence for debate. All comment welcome.

I thought it was only illegal to use the "interactive communication functions" of the phone whilst driving. If so, his phone records should soon clear him. I can understand that the police would have suspicions that he was making up excuses, so it should all come out in court.

All this said, it highlights a point made previously about this law not being necessary or suitable. If he was driving poorly due to being on the phone, then there were already laws to cover it, all this phone specific law does is allow cases like this.

Do hit listen again on this. I tell you it scary. I not use handy ever in car.. but I can see lots being hit by "literal interpretation of "use""
