As the title suggests I have been accused of travelling at 89.56 in a 50 limit in my car. It was a 60 limit upto about 2 months ago. I know I was speeding, but didnt think it was as much as that!

The system used was 2 sensor pads on the road, and it calculates the speed by the distance/time system. I understand that the police, who were travelling in the opposite direction, then had a system in their vehicle which calculated/read my speed.

I am due to receive a court summons sometime and my question is simply ....... am I likely to get a ban?! And if so, if its the short term ban, do I have to retake either my car license, or my bike license?

I have 3 points on my license, which I picked up December 2005.

Any advice would be welcome, because as each day goes by I am worrying more and more.

Also, what affect should I expect on my car insurance?

Sounds like VASCAR, but I don't think that can be used in the opposite direction. Presumably they turned round and followed you and that's when they calculated your speed? (If so, didn't you spot them...or were they in an unmarked car?)

Not automatically. The magistrates can impose that if they want, but I believe it's unlikely for a speeding offence.

For this latest offence, you'll either get points (6 I'd imagine), or an outright ban but no points.

It will go up quite drastically. Your existing 3 points may not have had much (if any) of an effect, but a ban would, as would 6 additional points (to a lesser extent).

Not much good news I'm afraid, despite it being perfectly possible that you were driving safely at the time. (One or two on this site may be sanctimonious towards you despite knowing nothing except your speed...you have been warned. ;))

Thanks for your practical advice .... in truth only I know if I was driving safely, and I was!!! For those that know the road, it was the A515 Ashbourne to Buxton road, the straightest part of that road, with no other vehicle on it other then the vehicle I was over taking, and not within the 'no overtaking' area, this road has recently been restricted down to a 50, which IMO in madness.

As I say I truly cannot confirm nor deny if I was travelling at that speed, but I was certainly over the new limit..... I was overtaking the said, slow moving vehicle, so I was accelerating.

Once I had overtaken, and moved back into my lane I slowed down, and I then saw another vehicle come round the corner, this was the police vehicle! He turned around to follow me, by which time I was certainly down to the speed limit, or there abouts! He led me to believe that he had my speed recorded before I even saw him .... not because of my lack of awareness, but because he was around the corner.

Again thanks for taking the time to reply ..... and the warning about other peoples perseption of what they think I was doing ..... I cant change what other people think, I'm not sure I am bothered anyway, I came on this forum because I wanted genuine knowledgeable advice, not opinions or judgement :wink: Sounds like I will get enough of that in court :roll:

Ban likely, but not a 6 month ban. I think they reserve those for people with 12 points. For blatant speeding such as this, it's likely to be a 1 month ban, possibly not even any points, but a hefty fine - maybe £500.

About 10 years ago, a friend of mine got caught at 115mph on the M25 in Essex. He got a 4 week ban and a £500 fine, but no points.

If you insure with Swinton, I'm led to believe they no longer penalise certain speeding offences - however it may depend on the offence code.

Thats reassuring .... I am with Swinton! will see what happens, thanks for the helpful advice. I think I am expecting a short ban and fine, fair enough I guess :oops:

89.56mph is ludicrously precise given the inaccuracy inherent in a manually operated Vascar device. However, it is sufficiently above the limit to render any accuracy challenge unlikely to succeed.

If its vascar then there would be video evidence wouldn`t there??

Also dont the police using vascar like to show you the video

Is there actually any evidence??

I'd plead not guilty get the evidence then plead guilty if its bang to rights

The only evidence needed is the word of a police officer backed with corroboration. Corroboration could be a video, or it could be the word of a second police officer.

Sorry mate but knowing where you did it your stuffed. Half way down that stretch is a farm, the plod are very often in the gateway. As you said up until not long ago it was a 60 but now Derbyshire is more or less a blanket 50. My better half got 60quid and 3 points in Buxton, just for parking opposite a solid white line, traffic didn`t even have to cross it to get past.

Re the pads. Around the area there are alot of these pads slap bang in the middle of the lane, nice slippy metal one`s. Not a problem until you touch one on a motorbike!
