I find this totally amazing. He goes through a give way and kills a cyclist abiding the law and gets a fine and points.
compared to the woman in southampton who goes through a green light and kills a red light cyclist and gets four years in jail.

Of course, if his phone had rung 5 min either side of this accident he too would have had 4 years in jail.

... or compared to Weakest Link Robinson who got a £100 fine £50 costs and a six month ban for speeding a few times but killing nobody.

no, no, NO!

he was fined £275 for not looking properly before pulling put!

It is for the criminal courts to punish culpable actions, not their unfortunate consequences

neither is it the job of the criminal courts to put a value on a life. that is the civil courts job. In any case the £275 fine is a TAX and will go to feed the insatiable maw of the treasury not the victims dependednts!

The civil case againts the driver/drivers employers will undoubtedly place a "Value" on the victims life several orders of magnitude greater than that of the fine, And unlike the TAX this money will help to support the victims dependents.(less the ambulance chasing lawyers cut)


The driver will probabally never drive a truck again (He will likly neither be insurable nor employable)

Unlke the wreclkless cyclist in the other thread who deliberatly cycled, at speed, into a group of pedestrians because they wouldnt get out of his way I cannot see how socioty would benefit from either a larger fine (He is out of a job and wont be able to pay it) or a prison sentance (which costs the rest of us upwards of £70,000pa and should be reserved for those who pose a real and continuing threat to the rest of us-which he doesnt)

By that reconing the lady who killed a cyclist should get £275 fine for not noticing the red light cyclist and a £60 fine and 3 points for using a phone rather than the 4 years prison

That is correct.

And possibly not even that.

As reported (IIRC) the "Red light cyclist" went into the side of the lady drivers car, not the other way round.

I suspect that the sole basis of her "Guilt" was the fact that she had been using a mobi nearly 1/4 mile before the junction!

I dont know if a civil case followed the lady drivers conviction but I would suspect that damages awarded againt the lady driver would not prove substantial on the grounds that, despite the (aledged) carelessness of the driver, the "Red light cyclist" was nevertheless largly responsible for his own destruction.
