Hi, I'm getting quite confused despite many hours of study.

I was doing 36mph in a 30mph, where no adequate system of street lighting exists (it recently previously was a 40mph zone.)

AFAIK, correct signage existed to determine the start of a recently reduced 40mph to 30mph zone, but no consistent street lamping exists. I thought that this meant that repeater signs had to be put up, and as I understand it DfT's TAL 1/95 strongly suggests the maximum recommendations for repeater signage distances in order to be termed "regular"?

Well there are 4 repeater signs in total, 3 that are visible. The distance from sign 2 - 3 is under 250m (on alternate sides of the road), and the distance from sign 3 - 4 is under 250m (on alternate signs of the road); However sign 3 is under foliage and it cannot be seen clearly. The distance between sign 2 - 4 (same sides of the road) is >480meters and before you even see sign 4, your speed is recorded. Is this technicality worth fighting or not?

Also I realise that DfT's TAL 1/95 is considered "strong advice" according to the aide memoire, but if that document doesn't define the word "regular", then how do you know whether the repeater signs in an area constitutes "regular" or not, and therefore legal or not??

Thanks for the consideration and help on this matter

TSM 2008 states that is street lighing ends there should be a repeater sign within 100m then at regular intervals.
http://www.dft.gov.uk/pgr/roads/tss/tsm ... apter3.pdf

Speed limits signing starts page 106 (hint type 106 in the page no then hit enter)

paragrapg 14.22 page 117
Quote:
14.22 Where a 30 mph speed limit is imposed on a
road without street lighting, it is necessary to make
an order. In this case 30 mph repeater signs must be
provided (direction 11(2)). Where a road subject to
a 30 mph limit has street lighting for only part of
its length, it is recommended that the first repeater
sign for the unlit section when leaving the lit
section should be placed at a distance of not more
than 100 m from the last street lamp.
Where two
consecutive street lamps within a system of street
lighting are more than 183 m apart (185 m in
Scotland) repeater signs should be provided on the
section of road between the two lamps. That part
of the road must also be covered by a speed limit
order as it is not a “restricted road”
(see para 14.21).

Please not that TSM itself is not law, it is best practice guidance based on the law TSRGD 2002

ie didection 11(2) of the TSRGD 2002

“It has never been the rule in this country – I hope it never will be - that suspected criminal offences must automatically be the subject of prosecution” He added that there should be a prosecution: “wherever it appears that the offence or the circumstances of its commission is or are of such a character that a prosecution in respect thereof is required in the public interest”
This approach has been endorsed by Attorney General ever since 1951. CPS Code

Take photos. You should see a red rectangular sign advising of this change? I am going off this area's attention to detail though..

Did they recently change a :40: sign to a :30: one and not cut back the foliage? They can't complain that they hadn't noticed it was a bit covered up...

I agree with above :)
Plus check that the council approved the - (if) new 30mph reduction to that road and exactly what/where the approval covered ...

Were you offered a 'course' at for - that 'speed' is often suitable for their courses? (Not that I don't agree with education - just the right education for the right reasons) ...
