As points are built up towards a ban, you dont get points if a ban is issued.

Thanks for comming back to us. I am glad you were able to go to court with as much information as possible. I think your sentance is fairly consistant with the norm. I hope your employer can work around your ban.

This approach has been endorsed by Attorney General ever since 1951. CPS Code

He effectively had a "clean" license though, since his points were past their sell by date.

Points have to declared for three years for the routines such as hiring cars and so on. You have to declare to insurers for 5 years - and they are only removed from the counterfoil and DVLA record after 4 years.

It may then have mattered last year when the points were 4 years old - but not this time as completely irrelevant and will not feature at any one time in the hearing of this case - which focuses on the unwise choice of 112 mph on a a stretch of the M6 which employs "stealthmobiles"

To Richard .. be yourself in court. Dress as you normally do for the office, Be as honest, candid and calm as per your opening post and explain the circumstances with the same regret which comes across in your post. Whatever happens - you are not looking at a prison sentence and the worst outcome - would be a short ban as fisherman points out. If you manage to convince of undue hardship - you may receive 6 -9 points if they wish to give benefit of doubt on a short ban.

Let us know how it went - good or bad - and don't let it put you off driving or the police/magistrates  You need COAST or the IAM's help to keep it safer

Correct me if I'm wrong but points can be removed after 3 years at a cost of £30 but stay on police records for 4 years and the DVLA for 5 years. If you then want them removing then you have to send your licence together with £20 as I have just done.???

As far as I am aware the police do not keep any records of points. Courts certainly don't, they check the DVLA records when necessary and I think the same applies to the police. The DVLA are the official keepers of such records where they remain on file permanently.

Points for speeding are current for sentencing purposes for a period of three years. This is calculated from date of offence NOT from date of sentence. They remain on your licence for 4 years so that if a new offence is committed within the three years, but not sentenced until after the three years, all parties are aware of the points. I don't understand why this is considered to be necessary as all courts will have a DVLA printout to hand when sentencing. It is possible, when points have expired, to pay for a new licence which will not have the points on it. This will have no affect whatsoever on a court as they will be looking at the DVLA printout and not the licence.

Just another money spinner for Government again. I just had my licence renewed at £20. Think how many pay that fee and add it on to your NIP and it comes to £70. What a shower we have to contend with!!!! You pay for everything, "including expenses"

Let's hope his 'Invaluable experiences' to his employer has helped his employer retain his services. :)
