In any case, all this sort of data recovery function should IMO really be part of the OS, the fact that "windows" cannot recover lost data seems to be a failing in the OS

You are not buying the software, you are buying the media it is stored on.
Your purchase includes a licence to use the software, on one computer.
With windows it gets even more difficult since the software actually checks that the pc in use is the one it was first installed on.
