Hmmmm, seems to me that far from non resident motorists wishing to use so called "rat runs" presuming to own the road, it is in fact the residents of such roads who generally make that presumtion. It is after all the residents who wish to restrict use of the road to themselves thereby denying anyone else access to a resource which they have contributed to, and have rightful use of.

How about this .... let residents of such roads buy the road and make it a private road. Then they can put up barriers to restrict access as they wish, hell they could even dig it up if they wanted ... of course they might want to leave access for emergency vehicles, delivery vehicles etc., but hey that'd be up to them. They'd be free to provide maintainance, provide lighting, provide gritting services etc. entirely as they wish, they'd have full control over everything and ..... nobody else would be using their road, problem solved!

Nope ... I don't see many takers for that idea either .... lol

Just as a matter of interest, are there any speed limits on private roads?

That is what is known as an "unadopted road" and they are quite common, even in the middle of cities. Short of fitting locked gates, and gated estates are not uncommon, they would still be usable as rat runs. Once a road is adopted the Highway Authority has no power to unadopt and sell it.

The legal distinction is not who owns the road but whether it is open to the public. So a supermarket car-park, access roads on a golf course, the grounds of a large country hotel are all "public places" and, as such, subject to the same traffic regulations as the open road. There was a case last year where a hotel owner in Scotland was prosecuted for driving round the grounds of his hotel on a quad bike whilst inebriated.
