A friend of mine has received a NIP from Cambridgeshire camera unit. He phoned them to ask for the photograph to be sent to him. They refused saying that they do not have any facilities so send it and if he wished to view it he would have to go to Huntington. (Photograph taken by a Gatso)
I bet they have got the facilities to show it in court.
What the bloody hell is going on? :x
Any advice will be gratefully received
Anyone know a good Solicitor in Huntington?

My understanding is that you have to made all reasonable efforts to identify the driver.

I suggest a letter to the SCP restating the request for the photograph.

Refer to the phone call but state that your friend assumes that there must be a misunderstanding as you need the information to assist your investigation into the identity of the driver and that you cannot believe that it is 'reasonable' to expect someone to take time off work and travel a considerable distance to view photograph that could be easily posted. The administrator your friend spoke to MUST have got their facts wrong

State that you are aware that the burden of proof for such offences is 'beyond reasonable doubt' and as such your friend take their duty to identify the driver very seriously.

sign off with with your sincere hope that they respond to this letter forthwith so that the matter can be concluded expediently.

The friend in question is like myself a truck driver.
What has happened is that his company received a letter asking them
to name the driver of the registration in the photo taken by the camera.
Although he was driving the said registration at on that date he was not in the aria of the camera.
That’s when I told him to phone the camera unit and get the photo.
The vehicle in question is an articulated truck and that is possible for driver from a previous day may have left the number plate on the trailer that the camera had taken (companies that operate articulated vehicle’s always have more than one rear number plate.
He is rightly concerned that he is going to get 3 points on his licence and a fine for something he has not done

The Cambridgeshire camera partnership refuses point blank to send the photo.
One phone call and Two letters (one including stamped address envelope)
Also they state “the nip does not have to be signed by law.”

WHAT! ON EARTH IS GOING ON IN THIS COUNTY?????????

I suggest he writes/emails his itinery for the day in question, and suggest that since HE is obviously not the driver, that he looks forward to his day in court, and having taken what steps he can to prevent them from ending up looking any more stupid than they do already, it is now up to them, but that he will be looking for compensation for the wasting of his time.
CC. the letter to Sky News, his MP, his local paper, local BBC station and the Chief Constable.

If all else fails, Steve Callaghan of the Cumbria Safety Camera Partnership has proved to be effective in getting to the bottom of such problems!! :lol:
