Seriously, the fault would be that of the overtakee? The overtakee has to see the overtaker in the mirror, where as the overtaker is going to be seeing the overtakee through the whole of the manoeuver (someone overtaking in this situation doesn't check their mirrors before they overtake

), AND has time to sound their horn to alert the overtakee.
That said, overtakee is almost certainly capable of stopping an accident through careful observation, as Adam has been doing so far - but I don't have much sympathy with someone hitting it.
If I saw this and it was obvious from road position and indication that person was turning and was overtaken - then I'd be having a little word with the overtaker.
Trouble is - lot do not sound horn or flash to alert overtakee of presence either - as they do not even register the road position and the indication (if indicator bulb is dirty, stuck or dead) In Adam's situation - I'd do hand signals as well and might even consider sounding horn myelf to alert driver behind if he is blinded by the sun or something

The sound may alert him to at least see the hand waving the right turn sign.

Assuming he has of course - er - read - er the Highway Code
If no independent witness present and overtakee is adamant he signalled and places his road position correctly... one word against the other and blame gets apportioned in insurance discussions - usually does not get to court if balance of evidence could go either way - hence the cop out by inusrance companies of "doing a deal"
Usual scenario in a road situation is the chap turning into his own driveway...
Sometimes they swerve to the left and overtaker overtakes despite the signal. Because chap has arrived "home" - his concentration is about zero and he fails to do a lifesaver shoulder or wing mirror check - bit like the guy who doors another driver, cyclist or pedestrian. They just stop thinking as "driver" at this point!
