My NIP states that Contray to section S16 RTRA 84. However actually looking at the RTRA s16 convers the following:

"16.—(1) Evidence of the proportion of alcohol or a drug in a specimen of breath, blood or urine may, subject to subsections (3) and (4) below and to section 15(5) of this Act, be given by the production of a document or documents purporting to be whichever of the following is appropriate, that is to say—"

Surely this is wrong? Does this section not cover drink driving and not speeding?

It's possible that that error invalidates the S172 procedure and hands you a get out of jail free card.

However you may need to play it carefully to get the benefit. Don't do ANYTHING until you have some better advice. Ask over at Pepipoo...

Actually Sections 14,15 & 16 of the Road Traffic Regulations Act 1984 details the powers to impose temporary restrictions on roads by local authorities

Therefore I would presume that you have been NIP'd for exceeding a temporary speed limit somewhere on the road network.

Yes you are correct. However using the aproximate possition of the Speed Camera van I was caught speeding aprox 1500M away from Bassets pole which is where the work is taking place. Also the speed reduction of 30mph starts roughly 2 miles away from the island.

Section 15 of the RTRA 84 only covers what cannot be speed reduced and the timescale of any speed reductions and so is not a beakable offence by a motorist.
