Reading that, it appears that the smoking itself was merely a trigger for a medical defect that was already present.
However, there is no lawful excuse IMO as the guy had already had 2 similar attacks before this happened and he should have had the problem treated sooner (and if he was on a waiting list then he should have avoided smoking & driving at the same time as he obviously knew what would happen if he didn't).

That's all a bit literal, is it not? Or are you trying to elicit an aggressive reaction from the smokers in the forum.
The fact that the driver had suffered similar fits before and had not taken medical advice shows his stupidity in not getting a respiratory problem diagnosed. If the fit had been brought on by the fumes from a poorly-maintained diesel vehicle, would you have entitled the thread 'Diesel Kills...'? :?

Update or not, smoking itself had f*ck all to do with the driver being responsible for anybody's death.
The act of smoking was merely a trigger for an existing problem.

Frankly I don't believe him. People on a rap as serious as this will dredge up any plausible excuse. Remember, no-one is personally culpable these days - it's always the fault of someone or something else... the system / addiction / medication / upbringing / you name it.

The follow-up is merely confirmation.
