Article on the cover of the Mail today tells of a driver who killed a pedestrian, getting 18 months.
He has a previous ban - and was driving without insurance.
He will serve half the 18 month sentence, and has been banned for 4 years.
With his record, what are the chances of him driving while banned?

Quote:
Killer driver jailed for 18 months
16:10pm 3rd April 2006

A killer driver who sped off after mowing down a medical student on a pedestrian crossing, catapulting her 30 yards along the road, has been jailed for 18 months.

Jaswinder Lakhvinder Singh admitted causing the death of 20-year-old Abigail Craen by dangerous driving in Birmingham.

Her mother, Susan Craen, said: "The sentence is an insult to her. She is dead and the man who killed her has a small interruption in his life. This is no deterrent or punishment."

Singh, 45, gave himself up to police after Miss Craen's mother allowed newspapers to publish pictures of her daughter lying dead in hospital.

It emerged during sentencing at Birmingham Crown Court that the defendant, only months before, had got his licence back after being banned from the roads for 12 months for drink driving.

Singh, who has already served almost five months in custody, was told by Judge Daniel Pearce-Higgins he would serve half of his 18-month sentence. He also banned Singh from driving for four years.

Singh, a father of two, pleaded guilty in January to dangerous driving, failing to stop after an accident, failing to report an accident and driving without insurance.

Amjad Nawaz, prosecuting, said Miss Craen was on the crossing near the halls of residence in Pershore Road, Edgbaston at around 5.30pm on October 30 last year when she was hit by a Ford Mondeo.

She died at 1pm the next day, and Singh, of Ward End, Birmingham, handed himself in to police just hours afterwards.

Seleena Mahmood, defending, said Singh was fully aware of the suffering he caused Miss Craen's family. She said he did not stop because he had no insurance, but when he heard Miss Craen had died he handed himself in.

That's four offences, and only 9 months served! :x

And the powers that be wonder why the population has no faith in them. This kind of thing makes me absolutely livid. That scumbag should have been tried and sentanced the same as someone who had committed manslaughter, not as the case proves as someone who has committed a 'trivial' traffic offence.

(of course you and I know that it isn't a trivial offence, but it seems to have been treated as such.)

Didn't say he was speeding, therefore trivial offence. Thats the sad state of affairs in the courts today. (unfortunately)

Had exactly the same thing with my fiancee 10 years ago, the driver was drunk, had previous DD offences but the Judge gave a minimal sentance as 'he was not speeding'. Two dead but it's ok as you didn't break the speed limit. Have no faith in legal system at all.

According to the paper edition, he was doing 41 in a 30 limit.
The woman he struck was on a pedestrian crossing, and was flung 30 yards by the impact.

My question should really be who is the law supposed to serve?

Is imprisonment a punishment, or a preventative measure? Just lately, the press has highlighted the number of offences committed by people out on parole.
Serial offenders REALLY do need to have their ability to flout the law curtailed, IMHO. :x

According to today's Times:

Quote:
The Solicitor-General is to review the 18-month jail term imposed on a hit-and-run driver who killed a medical student on a pelican crossing. Jaswinder Singh, 45, from Birmingham, pleaded guilty at the city’s crown court to causing the death by dangerous driving of Abigail Craen, 20. Mike O’Brien will review the case under his power to appeal against “unduly lenient” sentences.

So he got about twice what a businessman got for giving a wrong name in a Section 172 request.
Says it all really.
Now we know what the priorities are.

His excuse given on radio today for not stoping was that he'd just got back on the road and had no insurance - :? :?

Perhaps the person sentancing should also be subject to a review , or a suspension of facilities, and made to attend councilling sessions for the victums.

Law's a complete ass.

Summer 2004 - Cornwall: Woman fined £83 for killling a pedestrian. High on drugs.. in possession.. no insurance... no licence .. banned for two years.

Excuse for this sentence? "She had suffered enough...."

But two hours prior to this per the "Express" paper that day - same court banned a young man for 2 years, fined him £400. His car was taxed, insured and he held a clean licence to that point...

His serious crime? He clipped a kerb and collided with a tree....which needed tree surgery..

(Wildy posted this to PH at the time. (around July 2004...) . generated a lot of outraged comment.. )

In the meantime - family signed mahali's petition, the Saunders petition etc./
