Just received my 1st NIP in 10 years of driving for 48 in a 40. Cumbria scamera van on the last weekend of the Easter holidays coming back from the lakes. Must've got hundreds of innocent motorists. As I had wife and kids in car, wasn't driving dangerously in the slightest. Was paying full attention to the road and other hazards. Don't know exactly where the van was sited but I bet it was just into the 40 zone, or coming out of it. I was driving, and there's no other drivers named on my insurance so I can't really claim I don't know who was.

Anyway...

Will this have any affect on my insurance premium?
and should I just accept it? (3 points, £60)

I can't see what case I have, apart from that I was driving safely for the conditions and keeping eyes on the road, hazards etc... not the speedo and bushes for scamera vans.

Are Cumbria well known for this sort of thing? I'm fortunate enough to live in North Yorkshire where (as yet, touch wood) the policing of roads seems to be done without the aid of these vans so it's my first encounter with them. Was always in agreement with "Safespeed" but this has just made me believe it even more. FUMING! I was driving safely, just happened to stray over the limit and get hammered for it.

It can be but you didn't seem to be able to counter that!
To pick you up on a point: can you show is where Paul Smith actually said that, or were you lying?

FF, yes Cumbria Scammers are absolutely notorious for carefully setting revenue raising traps in the locations where speeding is safe, and ignoring the real problem roads. Hey, they even got a mention in the Daily Telegraph last Saturday how devious they were. Welcome to Blair's Britain and stealth "velocity tax"!

It really is difficult to give any helpful advice about how to avoid them other than either to drive around with your eyes glued to the speedo, or to continually scan every hedgerow, bridge, layby and slam the anchors on any time you see any van parked. All this in the name of "safety"!

If you want to investigate the possibility of fighting it, go and register on PePiPoo and post a new thread giving all the details - less anything that might identify you, as the scammers are well known for deviously scouring the web to try and pre-empt their victims' legal defences. Keep every bit of paperwork you have received - including the envelope it came in if you still have it - and don't post anything back until you absolutely have to, and until you have sought advice.

Remember that this is all about money, not safety. Remember also that if it goes to court the business that runs the cameras doesn't see a penny of it, even if you plead guilty...

So what? Hitler was a vegetarian: so is my mum. It doesn't follow that there is 'guilt by association'.

Naseem crashed head-on because he was driving like a loon on the wrong side of the road. This has been discussed in other threads.

Ask for photographic evidence that it was your car as you do not recollect being at that location at that time and it could be a case of mistaken identity. Also ask for the location of the camera van.

You should get at least one photo, normally they send two, which may enable you to work out where it was if they won’t tell you.

If you then accept you were the driver then the photo or video evidence is personal information about your movements and under the Data Protection Act you can ask for a copy of the video evidence if it was an LTI 20.20 with a Speedscope, or for the photo graphic evidence. You would need to do that as soon as possible. If you get that you may then be able to check the validity of the speeding allegation and decide whether to accept the fixed fine or go to court.

I had a ruling from the Information Commissioner's Office that you should be provided with a copy of the evidence if you ask for it, so you can then determine whether to go to court if you believe you were not speeding, so let us know what happens.

BTW, just ignore the stupid minority, he is just talking out of his rear orifice.
