Hello Folks,
Well my lad has been stupid enough to have 2 cars parked on the road without insurance on them,both have mot and road tax but no insurance the police have come along and impounded both cars.
what do you think he will get?

My lad was working on the cars when the police come along.
The cars are for sale.

The standard penalty for no insurance is 6pts and a fine. The depends on the income, for a non-earner it is very low (under £100) otherwise £2-300 or so. It is technically two offences, ie. a possible 12pts but I doubt that will happen.

*However* if you can get a solicitor onto it then it might be possible to get a lower punishment. This person on PePiPoo escaped punishment (absolute discharge) when driving home a new car apparently without insurance:

There was another case about somebody who reversed one car onto the road to move another car, but I can't find that.

Surely when the vehicles are not being driven, different legislation applies?

Unless the Road Traffic Act has been amended, there is no mention of any requirement for insurance to be in force if a vehicle is simply parked on a public highway.

I thought they'd changed it / were about to change it so it works the same as VED?

As I said Sixy, unless it has been amended then no law has been broken (other than illegal confiscation).

I personally fail to see why any stationary (ie, parked) vehicle needs to be insured anyway. All policies clearly state that it is the driver who is covered, not the vehicle itself.

I've always been under the impression that a vehicle parked on the public highway must be insured? Oh well, you live & learn...

Hello,
just come back from seeing him.
The Police have said he is being done for selling cars on the public Hi-way.
He has had no paperwork from them was told the paperwork will arrive in the post.
He is at a police station now getting the cars released as he has sold them.

So the insurance thing is completely irrelevant then.

No he still say's the police are doing him for the insurance.
I will have to wait for the paperwork from him and see what it say's.

A vehicle parked on a 'road' is being 'used' even though it is not being driven.

The only exception is when it ceases to be a 'motor vehicle'. i.e. It has been dismantled to such an extent that there is little likelihood of it ever again functioning as a vehicle.
