hi all and hope you can help ..

just recieved my court summons today acctual date of offence 3/12/05,over 6 months ..
they say i was doing 40 in a 30 zone strange as 200 ft back from where pic was took is a standard speed camera..i was snaped by a car that was sitting off road 4 lanes and 20 ft of grass to my right aprox 170 to 200 ft back.
i am going to try and prove that there was mis use of the equipment or interference...
1) line of sight on the pic sent as evedence has been broken by a 1ft in width pole ..my bike is half hidden behind this ..
2)because of the distance and an angle of 45 deg and as i was travelling away from the lti 20/20 there would have been a cosine effect up to 12mph ?

3)because in all 3 of the pics i am targeted in difrent positions in a space of 1 sec it could have been a sweep error that caused me to be seen as doing over 30 mph.

does anyone think i have a chance of beating this on these points as i really was't doing over 30 i travel the same route day after day up to 4 times a day and you can see where the police car parks from a distance away and having normal speed cameras on you can't really speed any how ..

the bike was a rs125 and i'm 40 just use it for getting to and from work ..

It's difficult to comment from a wordy description alone.
Could you scan and post pics of all the photos sent to you? (your VRM and log number [big number in middle of top line] blanked out).

That could be naughty (except for point 3)

This effect (whatever the value) will always be in your favour (it will always take away from the speed reading)

Chances are only one photo showed your speed (the others for driver ID). I will need to see them before I can comment.

You need to get legal advice, I'd suggest that you go to Pepipoo for a recommendation of a solicitor bt someone like John Josephs.

The picture that includes the speed is very suspect as that pole is bang in the middle of the frame, I am no laser expert but that is a definate argument.

Additionally the car infornt of you is clearly travelling faster than you I do think that as you are convinced that you were not travelling greater than 30 mph you should fight

Thanks Flearider. A picture says 1000 words and all that!

The middle photo is the one that counts. ACPO states “Attended Actively Operated Devices: Presentation of Evidence: The target vehicle must be kept within direct sight of the operator of the device at all times throughout the period of observation and check.

The geometery of that setup (the post) is very naughty indeed, I’m surprised the gun even gave a valid speed reading at all.
IIRC, the speed is displayed for only a few frames after the measurement ended, that would have put the post perfectly between you and the operator.
I don’t see how the post could affect the speed reading from your bike, which leads me to suspect the gun was misaligned and hit something else completely.

Is it me or is the car in front of you actually pulling away from you? (or were you riding at an angle?) It might be worth giving the DVLA the £2.50 to get the contact details of that driver to see if/what they got done for.

I reckon the SCP would quietly drop your case if you decide to fight it.

Would I be right in assuming you‘ve already pleaded ‘not guilty’ to an earlier NIP?
