 Post subject: Private Car Park Law

hi,

been reading this forum for a while and am amazed at how ignorant the law is.

i've now got a query tho....

what's the law in a private car park (i.e. Halfords who own the land)?

can the cops come in and check your car over and give you a producer if they feel like it? even if they didn't follow you in off the road?

i was sitting in a halfords car park after buying some bulbs for an indicator, in a car i had just bought, that had no tax. cops spotted this from the road on the way past then came in and checked me out and gave me a producer and are going to report me for the tax.

they hadn't seen me enter and didn't manage to get me to admit i'd driven it in, so what's the deal here then? :?

Fairly sure that the law now considers all private carparking areas to which the public have free access to be public roads these days. Bad for you in this case, good for you if someone trashes your car in a carpark and legs it.

The drink-drive law certainly applies to "a road or other public place", i.e. anywhere the public have access. Therefore the police can be within their rights to breathalyse someone on a pub car park.

I would imagine the same applies to other offences, such as using a car without valid VED.

As I recall the law was tightened up a fair few years ago because joyriders were running around in supermarket carparks and plod couldn't lay a finger on them.

That was back in the day when supermarkets actually closed...
