I used to work as a clerk in the magistrates' court and this was not as uncommon as you might suspect (assuming all those who it supposedly happened to were being honest :roll: ). There is a mechanism for ensuring justice is achieved in these cases. When someone does not answer a summons due to no knowledge of it, and as such is found guilty in their absence, to then later become aware of the case (when bailiffs show up for the telly for example) then they can attend the court and sign a 'Statutory Declaration' (StatDec). This is testimony that they were genuinely unaware of the proceedings against them, and results in the default judgment against them being set aside, without prejudice. It is then down to the CPS to decide whether to bring the case before the courts again. In my experience they often don't for more trivial offences, due to the additional costs against their budget.

Falsely completing a StatDec in an attempt to evade justice constitutes perjury, and quite possibly perverting the course of justice as well! If discovered it will almost certainly result in a custodial sentence!

I found piratenews's comments about the 'sixth amendment' quite amusing. I believe he is referring to the US Constitutional Amendments, of which the fifth (not sixth) protects against being compelled to self-incriminate. Of course we have no such protection as deeply enshrined over here, though PACE should offer some degree (hence the theoretical validity of the 'PACE Statement').

While its a relief that there is some kind of mechanism to sort out these foul-ups. I still hold that it isn't right to entrust something so important on the normal post. I've had an early morning visit from a bailiff (7am) - and though I wasn't expecting him I knew I had a situation (Council Tax arggh!!) and had read up on how to deal. He was very insistant, endlessly told me if he left empty handed it would only cost me more etc etc. So if one turned up completely out of the blue, who knows how you'd react to that kind of pressure - did anyone see the BBC expose?. Surely if would be far simpler to issue summons as mail that has to be signed for.

Back to the original post: 3,000 Deaths a year is really not worth concerning ourselves with. So, OK, last year 3,000 people where killed on the roads but 645,835 where born!

Driving is an inherently DANGEROUS thing to do and people will die, short of padding the inside and outside of every car with mattresses we will never stop the deaths and injurys...

Speed cameras, legislation, driving bans, traffic calming, none of this will ever make a dent in deaths on the road...

Me, ive been driving for 15 years, i drive fast, i get to where i want to go and i have NEVER been the cause of any accidents from my point of view i am punished for the idiots that dont seem to be able to control a vehicle and the more of them we can get shot of, the safer the roads will be :twisted:

My reading of your post is total arogance - the oposite of good driving.

15 years and you give advice .
Now , like me in here - i have 40 years experience and am NOT TOO PROUD to listen to some advanced drivers --listen and you might learn --i have and am not too proud to admit it . Learning to drive starts when you pass test and continues untill you give up licence - my dad ,aged 85 ,non driver admits to learning even now.

So sit down , shut up and listen to about over 100 years of police driving experience(combined) ( --not that old IG are you) :lol: :lol:

I hope your post is tongue in cheek because it comes across (to me anyway) as quite blasé.

OK you’ve never caused an accident, it doesn’t mean you didn’t cause a risk of one (or get caught up in one?); it may by that you’ve just been fortunate and your borrowed time is running out.

Well, yes chaps, I am quite arrogant, thats what one gets for being intelligent you see :lol:

It does not, however negate the fact that both of you are wrong, I am very VERY careful and considerate driver, awlays have been, always will be and i have no doubt that i will remain accident free until i die!

I have known how to drive since i was 7, i was brough up on a farm, i also have 6 older brothers, all of which are bad drivers and i have learnt from watching them.

Arrogance aside check my posts and you will see i have been made a scapegoat by the courts to excuse the in-considerate actions of 3 selfish and in-attentive drivers.. I am now banned from driving an may well get locked up for a year too (even though i have not damaged ANYTHING or injured ANYONE) prooving that the favour is stacked towards the fools and in-considerate where the courts are concerned...

Sorry, no. It doesn’t mean we were wrong. I can only hope that you really are an attentive, lawful and considerate driver – which is hard to believe considering you have been involved in several ccidents; I’ve never had any problems with ‘puller-outerer drivers’.

What’s the likelihood that all the brothers think that all the other brothers are bad drivers?

Other than the one you are being prosecuted for? Then again maybe it was deliberate so I guess that would not count as an accident.

Problem is cure , if this site is going to be known as a good driver/set them on road to better driving- or can we help ?

Think the problem is like that with alcoholics /smokers wanting to give up- they need to want to

No one can be "accident free". Humans trip up... bump into things and people .. even when walking. Burn fingers when cooking.. cut fingers in DIY .. and sometimes are in the wrong place at the wrong time.. and tragedy results.
