..and anyone else if they have a good idea.

Right, what criteria do the beaks use to adminiser the level of points/fines that someone should recieve? Do they take into consideration all the factors such as personal, location, driving record or whether you wear a shell-suit or not?

Reason I ask is that I often read about people who have caused monumental accidents yet only get 6 points and a £300 fine yet a wifey prangs here car into someone and gets an £800 fine and 1 year ban so it seems that the punishment is disproportional to the incident a lot of the time. Thanks for any replies.

The courts usually take level of speeding into consideration ... a serious blat is likely to be dealt with harshly - higher fine for example and sometimes between 1 and 3 extra points depending on how much a violation. But usually they stick to the 3 points and up the fine and add costs.... - based on my experience in the courts ... watching proceeding and giving evidence and so on.....


But if you turn up in shell suit .. they would regard that as a form of contempt and may be inclined to be harsher than they need .. so best to dress in smart suit or smart "casual" even if you do not posess a suit or cannot afford one.

Depends on the incident and amount of danger the accused caused to another as well....

How well BiB and CPS prepared the evidence and argued the case and of course a weak defence lawyer can also impact in outcome.

But what happened when the wife pranged her car? What were the circumstances? Who was hurt, and what level of damage did this accident actually cause?

And what typ of accident didthe others cause? Who and what was damaged as result?

And just sometimes .. you get the rogue judegement such as the one Mad Lad ranted off about last summer. The one where the bloke drove into a tree and received a £400 fine and 2 year ban and a drug addict killed someone, gets a 2 year ban and an £18 fine "because she had suffered a lot due to her addiction"...

Ok, well what about this? I was stopped (years ago) by trafpols-a week apart-for speeding on the main thoroughfare in my area-47 in a 30-at the same spot, same time of day, same weather conditions (OK) etc but I was let of both times although different officers on patrol yet my my old man was convicted with a fine and three penalty points for doing just over 70MPH on the A9 (60 limit) coming home after a family funeral and my Uncle being a drunk pain in the arse in the back. My dad explained the situation but they were emotionless and booked him. Makes you think why I was let of both times for being an ignorant young thing but the old man was booked for having possibly a valid excuse for 'pressing on' so as to speak but you would think most (MOST) trafpols would have been pretty leniant given the situation.

I suppose every situation is different but I hear a lot of quite unfair convictions like this.
