when I'm running advanced courses I always make sure that I plan 'fag beaks' for those who smoke. the risk is a crabby smoker under stress from the intense training wanting a cig and not being able to.

Things you SHOULD do.
It is not law passed before government that you MUST do.

CODE?

The ACPO Code of Practice does state that the device should not be operated from with in a vehicle. When used from a van as you describe, it has not been operated in accordance with the Code. While we do expect the police to follow their own code, it is not a legal requirement that they do so.

There is a diference with the acpo code of practice with speed traps as it is part of the conditions of the type approval. the LAW requires type approval and the home office ministers referes to the home ofice scientific development branch following the ACPO code of practice whilst type approving the kit. They also say that when false readings are found that ACPO code was not being followed.

“It has never been the rule in this country – I hope it never will be - that suspected criminal offences must automatically be the subject of prosecution” He added that there should be a prosecution: “wherever it appears that the offence or the circumstances of its commission is or are of such a character that a prosecution in respect thereof is required in the public interest”
This approach has been endorsed by Attorney General ever since 1951. CPS Code
