Dear All,

My partner was clocked at 38 in a 30 limit back in September. I own the car so I get the NIP. Close to the end of the 28 day requirement to respond I respond. After completely forgetting all about it I receive a summons in December as they hadn't received my reply. Due in court in February. I get a signed confession from my partner in which she admits the offence and offers to pay the fine, I plead Not guilty and send this off. Naively thinking this would be the end of it I sit back. The court date comes and goes. Then i receive a summons to the Magistrates court on March 19. My partner also receives a summons at a different time and court. I am amazed at the time and expense THEY are prepared to waste in order to get £60. Anybody been through this sort of palaver before care to comment? I'm actually on holiday when I'm due in court, would they adjourn it for me do you think? (I can guess the answer!). I wouldn't mind going to court to point out the wastefulness of it all but suspect I'd just make it worse!

Phil

I wouldn't make a statement like taht in court, I don't think they operate on a profit/loss basis.

Have you asked?

Sounds like you are being prosecuted for failing to identify the driver, can you prove you posted the NIP?

I have now asked for an adjournment and a very nice man at the court took the details of my case and said the court will write to me, although he didn't actually say they would move it!

They SHOULD be prosecuting me for not returning the NIP (and no I don't have any evidence other than my partner saying that I did) but interestingly the court order says "On 07.09.2007 at...drove a motor vehicle...at a speed exceeding 30 miles per hour" which is actually what my partner was in court for last week, although she couldn't attend and is waiting for the verdict having made an admission of guilt etc.
