Hiya

My partner has just completed his ban for speeding which when he went to court on the 1st march 2008 was for 28 days. Now as of tomorow (the 29th), is he allowed to drive again as he is no longer banned having fulfilled a 28day period, or does he have to wait until he gets his license back? cause surely thats him being banned for longer if thats the case,,, anyone has any experience of this?????

Contact the local police station and inform them. Take along any paperwork related to this. A check will establish eligibility to drive.

On Monday morning - phone DVLA or go in person to the local DVLA office: there are regionals to verify whereabouts of the surrendered licence which will be endorsed according to whatever he was banned for. :popcorn: If a tot-up - it will have TT99 for example. or SP50 or SP 60 (which was why the Cumbrian mistake that time was so important to correct as it affects loadings on insurance for 5 years :popcorn:)

Your partner is legally allowed to drive the minute that the DVLA receive his (valid) application for a driving license along with the correct fee.

If he should be caught driving BEFORE the DVLA receive a valid application form, then he runs the risk of being charged with "Driving otherwise than in accordance with a license" (a charge of no insurance automatically follows).

BUT surely the guy was supplied with this information as to how to proceed after or towards end of ban :popcorn:


Will still show fact of a ban though. It does not show spent points.. but it does show up the ban period and why all the same :popcorn: .. as far as I understand from the blurb on all this. I've a "virgin" licence still .. I suppose it must be because I am careful out there :popcorn: and generally legally at the safest speed for the road condition and fully COAST trrained too :popcorn: :wink: (

(IG is one hard guy if observing and evaluating :yikes: )

Magistrates do make sure you understand that you are not allowed to drive during the period of disqualification, and what the penalty will be if you get caught. However, I have never heard one give advice on how to get back on the road legally after the ban has expired.

If he drives after the ban is over but before his application has been received he risks being charged with driving with no licence when he could be covered. That carries a small fine, no points and no automatic no insurance charge.


Otherwise than in accordance with a licence - as the wording so cunningly suggests - only applies if you actually have a licence. It covers learners driving without L plates or driving a vehicle you do not have an entitlement for. It does not carry automatic no insurance.

in the event of a ban of 55 days or less the court should endorse the licence by hand and return it to the defendant on the spot. So no further explanation is needed.

If the ban is for 56 days or more it is all in the hands of the DVLA who should send an application form for a new licence before the ban expires.

correction to previous post, which was posted at the end of a very long on call when I couldn't get off to sleep.

Otherwise than in accordance with a licence is usually used to cover the circumstances I gave. However it does also cover driving where no licence has ever been held.

That does not alter my comments about possible charges the OP could face as he has held a licence.
