It is much more simple than a human rights case. for 4+ years the police used a laser gun on a duel carriage way. All the signs were wrong. They didn't comply with the law. Some were in the wrong place , some were missing. At the end of the trial lasting 3 days there was not one of the 16 cases that stood which refered to drivers at 4 locations on a road. Police addmitted that they never checked all the signs. (even though over the years they had provided thousands of statements to say that the signage was correct) At the end of the trial the judge had to admit that the limit had no validity.

Decision
R v Coleman 8/10/07 by DJ Gillibrand
Four steps to the decision
1. s.85(2) imposes duty on Hampshire County Council to erect and maintain etc traffic signs which comply with directions of Secretary of State for Transport.
2. I am satisfied that Directions 8 and 9 of TSRAGD 2002 have not been
complied with at Southampton Hill, Titchfield gyratory system and Ranvilles Lane, all side roads off A27.
3. I am equally satisfied that Directions 8 and 9 are mandatory, not advisory.
4. 1 am dealing with submission of no case to answer. I regard myself as bound by s.85(4) RTRA 1984. I regard that section as having a natural and obvious meaning. I propose to give it that obvious and natural meaning and not some strange reflection on when a speed limit rather artificially starts and ends or how a particular m/v arrives on the relevant road, being A27. 1 take that view because Regulations make it absolutely clear that the requirements in relation to traffic signs, whether terminal or repeater, relate specifically to side roads and as a consequence 1 find that so far as Mr Coleman is concerned, there is no case to answer.
As an aside I am persuaded that the envelope argument is correct. I say as an aside because it strikes me that my decision supports that contention because that is what the law says.
When Mr Carter was being cross-examined I thought it a significant answer to the question, which was that signing of speed limit, was not lawfully started, when he conceded that that was the case.
(this statemet allso covers the two aditional defendants

This was all in a reasoned summing up.
then at the appeal of some other motorist he refused appeals on the grounds that justice must have some finality.
Then a straggling case came to light.

solicitor: You may be interested to hear that on 9th September last at Alton Magistrates' Court DJ Gillibrand did a complete volte face and convicted a client of mine for exceeding the 40 mph speed limit on Southampton Road, Titchfield despite the fact that he was on the same stretch of road and was within the same defectively signed speed limit as Mr Coleman who was acquitted as the test case on 8th October last year! Indeed, there were more signing defects evident in the recent case as a change of the de-restricted speed limit to a 40 mph speed limit for the northern section of Southampton Road brought into the equation flawed terminal signing at three junctions on the west of the enforcement site. This was despite the fact that at the recent trial Mr Bentley adduced evidence to show how the three flawed junctions on the east of the site were now subject to materially changed signing put in place this year with a view to addressing the shortcomings highlighted in Mr Bentley's 2006 Coleman report!!
Pursuant to the client's instructions I have requested the DJ to state a case for the opinion of the High Court. If this case proceeds to the High Court it will have huge implications for signing law as the defects in the signing are largely agreed by the experts.
The Southampton case to be heard in January 50+ motorists were convicted when a temp speed limit was signed on the main road but not from side roads including the main container port. The defence argued that it was the courts case to prove they had passed adiquate signing. The prosicutioin argued that there could be two speed limits on the traffic. The court decided it was for the drivers to prove thier route past the inadiquate signing also deciding thet there fore two drivers driving side by side or even in the same lane were subject to different speed limits.
In reality there cannot be two differing speed limits for the same class of vehicle on the same lane, The speed limit was not clear. The reason they could not refund is they could not afford to lose face or cash.
We will see what happens in January at the appeal but I am betting on prosicution winning.
