I to am not a speeder and have just been fine £525 and had 6 points on my licence for travelling on the A556 on my return from Winsford to Edinburgh.
I have been done for failure to provide the name and address of the drive of an HGV travelling on the A556.
I would of provided this information but had left Robert Burns Transport LTD and was working for Boyle Transport running to Italy and was away from home for long periods of time. I would of helped if the letter they sent was recorded and then these twats would of had a wee clue i hadn't reseived it.
So cut a long story short I'm out of work and the state can provide for me now and its going to be a four year holiday.
So Mr G Brown up yours and spit on your laws. I don't need somebody to hold my hand but I always thought you were innocent until proven guilty but in this day in age I seem to be very very wrong.

You must have got some post or you wouldn't have known you have got 6 points. If you had contacted the court at that time and told them you had no knowledge of the NIP or of the court proceedings it would all have been cancelled. They might have issued a new NIP but at least you would know about it and could have avoided the 6 points and had a chance to put forward a defence against whatever the allegation of speeding or whatever it was that gave rise to the NIP.

Did you actually receive any of the court papers and attend court. If this was all done without your knowlledge and in your absence you could apply to have the whole case returned to summons stage where you can present your defence.

Also if you are unable to pay the fine and circumstances have changed you can apply to have the fine reduced to match your reduced income.

hello all
first post on this forum.
like rod i am also being proscecuted for speeding on this stretch of road.
today my employer(of a well know convienence store)informed me that i had been caught speeding on the A556.
like a lot of other HGV drivers i thought it was a dual carriage way and after reading some of the posts on here im proven wrong!
problem is i have 9 points already on my licence.
the transport manager told me there is a possibility of going on a "speed awareness course)
hope so i guess ill have to wait for the outcome.
with the amount of cameras and speed traps present doesnt it seem like easy pickings for the law.
i know if my house got broken into the police would take a day at least for a statement.
other than that i guess id have to plead hardship.
but sometimes i wonder if its worth bothering with at all cost of running a car today is astronomical dont you agree?

regards Andy

There isn't any possibility if you've been on one within the last 3 years, or you were more than about 10mph above the limit.

So if not, and because of the totting to 12 points, chances are you'll get a summons to appear in court. If so, you should prepare a case for mitigation to plead hardship resulting from disqualification (can't drive, support family/dependents, etc) and say why you thought it was NSL.

This sounds to me like this one is a recurring problem where honest mistakes are made. You would have thought that with speed being such a killer the powers that be claim it is  they would have made that limit far clearer; it seems they aren't doing anything about it and are instead raking it in :x

It always amazes me how they can put up signs like "changed road layout ahead" or similar, when it's stating the bleeding obvious 99% of the time but when they suddenly drop a limit by for instance suddenly taking the 40MPH lollipops away to make a 30MPH limit, they don't give you any warning. There's a road near me that was once NSL and has been 40MPH for at least ten years but now, I notice, the lollipops have gone....I enquired when the order was made..some two years ago it seems, although I would swear that they were still showing 40MPH about 6 months ago and my new sat nav still thinks it's a 40MPH limit.

My views do not represent Safespeed but those of a driver who has driven for 39 yrs, in all conditions, at all times of the day & night on every type of road and covered well over a million miles, so knows a bit about what makes for safety on the road, what is really dangerous and needs to be observed when driving and quite frankly, the speedo is way down on my list of things to observe to negotiate Britain's roads safely, but I don't expect some fool who sits behind a desk all day to appreciate that.
