there is a speed camera on the road i use every day to work, i always pay extra attantion when appoching it.

yesterday morning, when i was appoching to the camera (about 50-60 metre away,no cars infront of me), i saw it flashed twice, i checked my speed meter, it was 30 exactly. also i didn't notice there is any car speeding in the contraflow.

this morning, same thing happened again!!!

was i flashed? am i going to get NIP?? if so, how can i defend myself??

please help!

Was this a gatso (grey pole square box on top and back painted yellow) camera and forward facing to you ?
They can only be used on cars from the rear for speed offenses not with forward facing cars - i.e not from oncoming traffic.
However if you are setting it off, then I would try approaching it more slowly and complain to the local Police as flashes are distracting to all road users.
From your description and account it does not sound like you should receive any NIP but keep a note of all details date etc just in case !
All NIPS have to arrive in 14 days. If you do and you are forward facing (and I would find this highly unusual) then as far as I know they have no case.
Seeking legal advice is always advised (I cannot advise you legally as I am not in the legal profession) so checking pepipoo.com and their forums which have many legal advisers online or seek out a legal professional body.

thanks for your reply.

yes, it is a gatso cam. it just really bothers me it happened twice at the same spot...coould it be faulty one?

fingers crossed...

also, as xmas and new year holiday is coming, when do you think i will be safe if i didn't receive NIP by? thanks again!

If you want immediate piece of mind, borrow a friend's GPS (one that displays speed) and travel on a long-ish, flat, straight road maintaining 30mph on the car speedo and note what the GPS reads.
The GPS should show 30mph or less (the GPS is the accurate measure of speed), in which case you will be fine.
If the GPS shows 34mph or above then your car speedo might have dropped you in it.
I should point out that such car speedo errors, where they under-read, is quite rare.

Some camera partnerships allegedly set their Gatso cameras to flash at oncoming traffic to put the frighteners up them, but they are not type-approvedfor prosecuting oncoming vehicles, so don't worry.

thanks for the reply.

but such setting is really ridiclous isn't it? i mean you could daze the driver if you flash front on in the evening, which could lead to accident!

Gatso radar based cameras are nowhere near as accurate as the people who make money from them would like you to believe. I don't suppose there was a large vehicle nearby at the time? They like large vehicles. I saw one go off because there was a stationary bus near it. There's a reason they take two photographs.

IF you get flashed in your face by a Gatso ,complain long and hard to the police -on the grounds of road safety ,and quote breach of type approval .I did some time ago ,asking for action ,or I'd put a letter in my local paper ( not the sort of thing they want -local soliciters could have a field day) -needless to say got a call back to say camera tech on way .Don't get mad -get even .Makes you feel a lot better -did me .
