I saw a Lanca$hire talivan yesterday drive straight through a "STOP" junction without stopping....

What utter hypocrites these people are; lecturing the public "you must obey the law, because it's the law..." then behaving like that.

Obviously they were late for their revenue collection duties

Tell us "JJ" - if one of your talivans was caught doing that, would you dismiss the offender?

We should all get video recording equipment fitted to our cars and submit tapes of this sort of thing to the CPS.

Whilst I accept that they are being extremely hypocritical by doing this, I have to ask - would you have done the same in the situation? I can think of at least two stop lines near me that are utterly ridiculous - in situations with a clear view of all roads coming into the junction. And far more are placed in such a way that to stop there leaves you in a position to gain no useful information from the view you have. It seems that generally you're better off to stop about 1-2 ft in front of where you're told to, as then you're out of harms way but can actually see the oncoming traffic.

I can think of at least two speed limits that are utterly ridiculous... would they give me the benefit of thinking the same?

That's not the point. They're blighting people's lives by rigid enforcement of the law. Let them see what it's like to be on the other side of it.

Problem is how do you show his speed without incriminating yourself? Okay, you can have a video that shows your speedo reading the legal limit, and him going faster, but your speedo may well be under-reading, so that doesn't prove he was exceeding the limit.

It seems to me that you have exactly the same exemption that the police use when they are following 'speeders'.

Surely not? The Police have special exemptions that apply solely to them, e.g. the right to effectively assault individuals who they wish to arrest. Private individuals have no such exemptions as far as I'm aware.

:)

RTRA 1984 S87:

87 Exemption of fire brigade, ambulance and police vehicles from speed limits

No statutory provision imposing a speed limit on motor vehicles shall apply
to any vehicle on an occasion when it is being used for fire brigade, ambulance
or police purposes, if the observance of that provision would be likely to
hinder the use of the vehicle for the purpose for which it is being used on that
occasion.

Looks good to me...

So Paul, you're suggesting that under some circumstances, a private individual can claim that they are using their own personal vehicle for "police purposes"? Is there any precedent for this argument being accepted in court?

The law seems crystal clear. I don't have case references to offer.

I think where it possibly falls over is in the context. The heading of that paragraph is "Exemption of fire brigade, ambulance and police vehicles from speed limits ". I do not believe that even policemen, members of the fire brigade or members of the ambulance service in their own vehicles, even on a shout, would be covered by that paragraph (although nobody in their right mind would prosecute, but that's another story).

I'm pretty certain that the heading does not form part of the law. The law seems very clear and makes no mention of ownership, employment, driver skill or anything else to narrow it down. It is, in fact, a blanket exemption.

Limiting its scope requires an assumption regarding its purpose, but we are not required to assume anything in order to understand the law. The law is the law, as it is written, unless or until a court clarifies the intentions of the legislators. I'm not aware of any such clarification.

So if you see escaping bank robbers and fancy giving chase, go for it. And if you feel the need to record the speed of a speeding talivan, then the law is on your side. After all 10,000 speeding police cars can't be wrong can they? :)

It all comes down to: Law and: Case Law doesn't it?

It's one of those "Get outs" that the Heirarchy in this country have manufactured for themselves over Centuries by which THEY are NOT prosecuted as the:..............peasants are!

And they are still enforced and used, even now!

Yes folks, you're not wrong,............One law for them!.................One law for us!

Surely some mistake? Can I follow the bank robbers, and (when in no fear of my life - say they're stupid bank robbers and are driving down a four lane motorway at 35 mph) use the pit manouever on them :?

As posted on here once, I followed a wanted person while on the phone to the police for 10 minutes, and they never did do anything about it...
