Following Idris' High Court defeat on the "unsigned forms" issue I have agreed with Idris Francis to gather funding for an appeal to the House of Lords.
It's urgent that we get this funding appeal up and running because there is a limited time to lodge the House of Lords appeal application. The limit is 21 days after publication of judgment.
About £12,000 is needed.
Here's the proposal:
1) Donations would not be returnable if the case didn't go ahead.
2) First call on the funds would be the Idris appeal to the HoL.
3) Left over or unused funds would go into Safe Speed's general fund.
At this stage we cannot say for certain if an appeal will go ahead. We cannot decide until the judgment has been published, and even then there is the following question that must be answered: "Is taking this particular case further worthwhile?"
For:
* There's a chance of bringing down speed camera law
* In the HoL we get the chance to air wider "public interest" arguments
Against:
* The chances of winning appear fairly slim
* We might be able to do more good with the same cash spent elsewhere
* Even if we did win, they would probably go on and repair the law relatively quickly
* This isn't a major battle in the war for real road safety - it's just a side show
Unknown:
* The content of the judgment
I am inclined to believe that the opportunity to air the public interest argument in the House of Lords is quite a compelling argument. The case for speed cameras not being in the public interest is now an extremely strong one, and winning that argument could change the course of road safety history.
