how do i ask for the photos for the speeding without disclosing or signing the nip?

It depends why you need the photos.

If you need the photo to attempt to identify the driver because you cannot be certain who ws driving you should write to them and tell them so now. Recorded delivery.

If you know who was driving, but intend to examine the case against you, that comes rather later in the case. You need to deal with the S172 obligation first. The Pepipoo 'PACE witness statement' is a very promising way to deal with your S172 obligation.

From what I have read asking for photos "to help identify the driver" usually gets you photos without too much hassle. Even if you do know who was driving I don't think it is really an admision...

Some SCPs are trying to charge £10 for the priviledge of seeing the photo. It's not all about the money. :roll:

If you have accepted you were the driver then under the Data Protection Act you can ask for any personal information about you held by the police. That includes any recording of your movements in your car. You can do this now, before taking the matter to court. You should do so as soon as possible so you can use the information to help you check the validity of the speeding allegation made against you. This is so you can determine if there is a valid allegation for you to answer and if you wish to accept the fixed penalty offer, if made.

You could send a letter, or email, as follows to the police; “I am making a Subject Access Request under section 7(1) of the 1998 Data Protection Act that you provide me with a copy of all information you are holding with respect to the speeding allegation you have made against me. In case you should question this request, or claim exemption, I have been advised that the Information Commissioner's Office has recently ruled that I am entitled to such information at this stage of the proceedings. In this I also ask you to provide me with full information about the type and location of the measuring instrument used.”

If they still refuse then report back, or send me a PM.

We hope the advice and suggestions are helpful, but don’t expect the police or SCP just to give up. You can expect plenty of bluff and bluster and possibly various tricks.
