Got caught doing an insanely dangerous 34mph in a 30 zone by a mobile camera in North wales and recieved a fixed penalty notice. I was under the impression that if u only got prosecuted if u were doing 35 and over. Anyone know the score on this?

The ACPO cut-off is 10% + 2mph, making 35mph the first speed at which you'll receive a NIP. Theoretically they can prosecute for 30.01mph, but in practice they tend not to.

If you've genuinely got an NIP with 34mph on it, PLEASE scan it in and post it, because yours would be the first recorded evidence of an NIP with a speed lower than the ACPO recommended on it. Lots of people claim to have had them, but no-one has ever stumped up the proof.

At 34mph i told the courts that i wished to contest in the naive belief that they wouldnt bother. 3 months later i got a court date so even more naively i hire myself a hotshot solicitor who specialises in this kind of thing. £16.00 later he lose's the case even though the plod who set up the camera had failed to do so correctly.
My solicitor urged me to try for an appeal (this friday) and ive been stung for another £1000...its scary how these things snowball, iv had 2 keep all this from my wife, if she knew id blown £2600 she'd cut my knackers off. Just to confuse things my mother tells me that she heard the Cheif of Police for Wales warbling in a radio interview that no one should be charged with doing 35mph abd under.

Wow, get yourself over to PePiPoo now and check out the forums. You can get much better advice than your solicitor is offering you (by the sounds of things) for no money at all. In the event that you do need a solicitor, they will recommend one who knows what he's doing. Mind you, it all sounds a bit late now.

If you've got a scan of the NIP, blank out the personal details and chuck it up at http://www.imageshack.us or similar, they'll then give you the code to paste here to display it in thread.

I sympathise with you... :( :(

I suspect you are a hard working honest man, and easy prey for those who do nothing more than make the life of the law abiding public a misery.

You would not have been fined £2600.00 for driving three times over the drink drive limit, or shooting someone in the street. !!!!

INSANE is an understatement !!!!!!!!!

The Police are crap,...they are unable to catch real criminals and seek to punish motorists..they are much easier to catch and punish..specially since they have jobs and cars..very nice easy prey !!!

The Police are useless and pathetic !!!! waste of space :D :D :D

I hope your situation is resolved and you are not forced to pay this ridiculous sum ...

See your MP...may be able to help ???

Many thanks for the kind words and advice. Found out today at 4.30 this afternoon one day before the appeal that we've one, the appeal isnt being contested. So after putting me through the mill well and truly and emptying my bank account of £2600 these buffoons decide to drop the case. Id like to drop the dumb ass taff plod who thought he'd sting some tourists with his laser gun and the dopey git who gave him the greenlight to take it to court even though there boss the Cheif Constable of North Wale claims no one driving under 35 mph will face prosecution for speeding.

Ive now taken the hint and wont be setting foot in Wales for the foreseable future (even though im half Welsh), we the dum ass tourists subsidise thier 3rd world economy and then get fleeced thier bozo traffic police.

Well they can say what they like, but I won't be going to Wales while Adolph Brunstrom is in charge there and I will spend my money elsewhere.

I think Wales is a beautiful place, but I don't want to face a six month fight, at considerable cost, effort and distress because of inadvertently slightly going over a speed limit for a few seconds.

Most drivers getting speeding tickets are just trying to go about their business as lawfully and as safely as they reasonably can and the likes of Mr Brunstrom are not doing anything to make them better drivers.
